Membership terms & conditions
- We will agree to grant you membership and access to our website when you pay
- You will have access to all of our membership discounts and promotions
- You won’t have to pay for these individually
- Each discount or promotion has its own T&Cs
- You will be able to view vouchers on line to show or give to the retailer
- We will give half of your membership to your chosen school or charity
- Your memberships extends to you and your immediate family
- The membership lasts for 12 months and is non-refundable
- We will keep your personal data private
FULL TERMS & CONDITIONS:
1. Terms of reference
Within this agreement:
- Community Perks Ltd, Company no, NI651239, 115 Cregagh Road, Belfast, BT6 0LA are referred to as “we” and “us”.
- Members are referred to as “you”.
- Any singular refers to the plural and vice-versa and any masculine to the feminine and vice-versa.
- Immediate family means you, your spouse or civil partner and your children or dependants.
- Participating supplier means those vendors who advertise discounts and promotions on our members only section of our website.
2. The Service in general
2.1 We will offer you competitive promotions and discounts via our website for a period of 12 months from the date of commencement of this agreement.
2.2 We will work to ensure that those promotions and discounts are exclusive to Community Perks members and not available to members of the public who have not paid for Community Perks membership. We cannot guarantee this however and it is possible that similar deals are available through other similar schemes.
2.3 All promotions and discounts are subject to the individual terms and conditions of the supplier, but they will not be overly prohibitive or restrictive. Some promotions may be limited to a period of time or a maximum number but this information will be available to you.
2.4. You may obtain a discount or take advantage of any promotion advertised in our members only section of our website by selecting the deal and showing this to the supplier.
2.5 We will work continually to increase the number of participating suppliers, discounts and promotions available to members.
2.6 Upon receipt of your on-line membership application and payment, we will issue you with a user name and password to access the members only section of the website containing discounts and promotions.
3. Voucher Operation
3.1 If you wish to avail of a promotion or discount you will be able to select that deal voucher which displays a unique redemption code. This will entitle you to avail of that promotion or discount on production to the supplier. We will promote the use of electronic vouchers, i.e. you will show the redemption code to the supplier on your phone or media device and they will accept that, however some suppliers will still require a printed voucher and in such cases this will be made clear so you know that you must print the voucher to redeem it.
3.2 Depending on the discount or promotion, you may be permitted to download/use as many vouchers as you wish, or the supplier may place a restriction on the number of vouchers that you download/use.
3.3 Vouchers have a code which will be unique to the promotion. This code may be used to verify authenticity and permitted use.
3.4 Where you do not produce either the code on an on-line format, or a printed voucher, the participating supplier is not required to apply any discount or allow to you undertake in any promotion.
4. Restrictions on Membership and Use
4.1 To protect the integrity of this scheme, you and your immediate family are the only persons permitted to use downloaded vouchers. You may not give access to your membership to any other person, other than your immediate family. Where you do, you agree to pay us £250 per additional identified user, and we may cancel your membership without refund.
4.2 You may not give, transfer, sell or part in any way with redemption codes or downloaded vouchers. Where you do, you agree to pay us £100 per code or voucher and we may cancel your membership without refund.
4.3 You may not make duplicate copies of any codes or vouchers without the permission of us or the participating supplier. Where you do, you agree to pay us £100 per voucher and may cancel your membership without refund.
4.4 Where we believe that fraud or attempted fraud has occurred we may, in conjunction with any of our suppliers, report it to the police with a view to prosecution. This is without prejudice to any civil legal action which we may take.
5. Membership Fees & Donations
5.1 The cost of membership for you and your immediate family is £55 per annum or £45 with an applicable discount code.
5.2 For every membership sign up and payment, we will pay £22.50 to your chosen school or charity, subject to condition 5.3.
5.3 We will advise your chosen school or charity of your donation and will pay them that donation. Payments are made on either a monthly a quarterly basis. We will not disclose your name or any other personal details to the school or charity unless you specifically authorise us to.
5.4 Your membership will recur annually unless you cancel it before renewal.
5.5 No refund is due where you cancel membership within the year, or if you fail to use it, subject to Cancellation of Contracts Rights: You may cancel your membership within 14 days by emailing us. We have the right to charge you for any promotions or discounts that you have selected within the 14 days, regardless of whether or not it is used. This is charged at the monetary value of the discount gained, or the absence of that information, £20.00 per viewed or downloaded voucher, both of which shall not exceed the value of the membership.
5.6 Membership commences when payment is received by us.
5.7 You do not have to pay for individual offers, deals or promotions within the membership scheme.
5.8 In the case of any disputed transaction you agree to contact us and allow reasonable time to resolve it,or be liable for any unnecessary administration costs. Where you reclaim any monies paid to us which are rightly due to us, you agree to pay us a further £45 administration fee plus costs. In the case of any amount being due to us (for example where you breach these terms and conditions), you agree to pay us within 5 working days of demand and 5% above LIBBOR per annum interest on outstanding amounts after that period, plus any reasonable costs incurred in attempting to obtaining payment.
6. Limitations to Service
6.1 We will work to ensure that our service is available at all times, however we shall only be liable for ensuring full serviceability for 99% of the period of your membership.
6.2 We do not accept liability for you not obtaining a discount or promotion due to poor internet connectivity.
6.3 We do not accept liability for you not obtaining a discount or promotion due to any technical issues with our website, however, we will work with you and the participating supplier to obtain the value of any discount where this occurs, within reason. Where we are unable to do so, we may at our discretion, offer you an increase in the period of your membership, without charge.
6.4. We do not accept liability for our website not being available or not functioning correctly, however if this occurs for more than 24 hours, we may at our discretion, offer you an increase in the period of your membership, without charge.
6.5 We do not accept liability for a participating supplier not offering you any discount or allowing you to avail of any promotion where you a) do not produce the code or voucher as required; b) do not adhere to these or the participating supplier’s terms and conditions; c) act in a manner to the participating supplier, his staff, agents or patrons that is any of the following: discourteous, unreasonable, intimidating, threatening, immoral, illegal or violent; where you do we may cancel your membership without refund.
6. 7. Your Privacy & Data Protection
8.1 Northern Ireland law governs this agreement.
8.2 This agreement is binding upon the heirs, executors and administrators or other legal personal representatives of the parties.
8.3 Agreement shall be deemed to have been made where you submit, and we accept, your application by any means, including electronic.
